Abstract |
Background. The relevance of the study is determined by its scientific, theoretical and practical significance. In scientific and theoretical terms, the study of this issue allows deepening the understanding of the evolutionary development of Soviet legislation in the field of property relations in 1985 – 1991. In practical terms, the topic is significant from the viewpoint of exploring the negative experience in carrying out economic reforms in order to reflect such mistakes in the future. The article attempts to consider the evolution of the economic foundations of the constitutional system in the USSR during the Perestroika under M.S. Gorbachev, when the state had to choose the economic model for further development and to search for the ways out of the protracted economic crisis. Materials and methods. The article uses a wide range of party documents and law sources, namely Soviet legislation in force and Constitution of the USSR. The logical, historical, comparative and legal methods and methods of analysis and synthesis are used in the study. Results. The article substantiates the idea of the evolutionary development of Soviet legislation in terms of property relations, shows that legislation and Constitution of the USSR at that time did not meet the pressing interests of economic development and did not contribute to overcoming the deep economic crisis. Conclusions. Legal regulation of property relations in the USSR during the Perestroika period in 1985 – 1991 was characterized by its inconsistency and ambivalence, which were based on unsuccessful attempts to combine capitalist elements with socialist economic system. That ultimately led to the collapse of the USSR, which had, among others, economic prerequisites. |
